YOu escaped just the '\' character. You also need to escape the '|' character to prevent it being used as a command separator:
set formatlistpat=\\(\\a\\\|\\d\\)\\.
Better would be to use :let so you can avoid escaping altogether:
let &formatlistpat='\(\a\|\d\)\.'
